These Terms of Service (“Terms”) govern access to and use of the nomination platform available at https://nomination.arabianworkingwestern.com/ (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Overview

The Service is provided to allow users to submit horse nomination or related program information, make applicable payments, and manage related submissions online. The Service may be operated in connection with Arabian Working Western Alliance programs, including incentive fund or nomination-related activities.

2. Eligibility

You may use the Service only if you are at least 18 years old and able to form a binding legal agreement. By using the Service, you represent that the information you submit is accurate, current, and complete.

3. User Accounts and Submitted Information

You may be required to provide contact details, horse information, ownership information, breeding information, and other related data in order to complete a nomination or payment. You are responsible for ensuring that all information submitted through the Service is true, accurate, and complete.

You agree not to:

  • Submit false, misleading, or fraudulent information.
  • Impersonate another person or entity.
  • Use the Service for any unlawful purpose.
  • Interfere with or disrupt the operation or security of the Service.

We may reject, suspend, or remove any submission that appears inaccurate, incomplete, fraudulent, or inconsistent with program requirements.

4. Nominations and Program Rules

Submission of a form or payment through the Service does not guarantee acceptance, eligibility, award qualification, or participation in any program, class, futurity, or incentive fund. The applicable program rules, deadlines, eligibility requirements, and administrative decisions will control.

You are solely responsible for reviewing all applicable rules, deadlines, and requirements before submitting a nomination or payment. Late, incomplete, inaccurate, or unpaid submissions may be rejected or may incur additional requirements or fees where permitted.

5. Payments and Stripe

The Service may use Stripe or other third-party payment processors to collect fees for nominations, enrollments, or related services. By making a payment, you authorize the applicable payment processor to charge the payment method you provide for the total amount shown at checkout.

We do not store full payment card numbers on our servers. Payment processing is subject to the terms, conditions, and privacy practices of Stripe and your payment method provider. You are responsible for providing valid payment information and for any charges, fees, taxes, or penalties associated with your transaction.

6. Refunds and Chargebacks

Unless otherwise stated in writing, all fees paid through the Service are non-refundable once a submission has been made or processed. Exceptions may be granted only at the sole discretion of the organization operating the Service.

If you initiate a chargeback or payment dispute without first contacting us to resolve the issue, we may suspend or terminate your access to the Service and may reject pending or future submissions to the extent permitted by law.

7. No Guarantee of Results

Use of the Service does not guarantee acceptance into any program, qualification for awards, prize money, incentives, or any specific outcome. Eligibility and results depend on the governing rules, submitted documentation, deadlines, and administrative review.

8. Communications

By using the Service, you consent to receive communications related to your submissions, payments, confirmations, reminders, corrections, or account activity by email or through the Service. You are responsible for monitoring your email and providing a valid address.

9. Intellectual Property

The Service, including its design, text, software, logos, graphics, and functionality, is owned by or licensed to the operator of the Service and is protected by applicable intellectual property laws. You may use the Service only for its intended business purpose. You may not copy, modify, distribute, reverse engineer, or exploit any part of the Service except as allowed by law or with prior written permission.

10. Privacy

Your use of the Service is also subject to our Privacy Policy. Information submitted through the Service may be used to process nominations, verify eligibility, maintain records, communicate with users, and administer related programs.

11. Third-Party Services

The Service may rely on third-party providers, including payment processors, hosting providers, email services, analytics providers, or other technical vendors. We are not responsible for the acts, omissions, availability, or policies of third-party services.

12. Service Availability

We may update, modify, suspend, or discontinue all or part of the Service at any time, with or without notice. We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that any data will always be available.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR OF THE SERVICE AND ITS OFFICERS, DIRECTORS, MEMBERS, VOLUNTEERS, AGENTS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE, PROFITS, BUSINESS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID THROUGH THE SERVICE FOR THE SPECIFIC TRANSACTION GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

15. Indemnification

You agree to defend, indemnify, and hold harmless the operator of the Service and its officers, directors, members, volunteers, agents, affiliates, and service providers from and against any claims, liabilities, damages, judgments, losses, and expenses arising out of or related to:

  • Your use of the Service,
  • Your violation of these Terms,
  • Your submitted information,
  • Your violation of any law or third-party rights.

16. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, submitted false information, engaged in payment abuse, or used the Service in a way that could harm the platform or its users.

17. Governing Law

These Terms are governed by the laws of the State of Missouri, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Cass County, Missouri, and you consent to that jurisdiction and venue.

18. Changes to These Terms

We may revise these Terms from time to time by posting an updated version on the Service. The updated Terms will be effective as of the listed effective date. Your continued use of the Service after revised Terms are posted constitutes your acceptance of the changes.
